Trademark Services

Trademarking your product names, business name, logos, slogans and/or Domain Names is one of the most important business decisions you will make. We're here to walk with you through the somewhat complex trademarking process.

Trademark holders have the ability to prevent their competitors and other third parties from using their registered trademark without permission. A trademark is essential for all companies that profit from product name or business name recognition.

Companies who fail to register their trademark, or companies currently conducting business using an unregistered trademark, run the risk of losing some or all of their rights to continue to use their mark. This normally occurs when a competitor or unrelated third party trademarks a mark that is the same or substantially similar to an existing mark. Few companies have the financial strength to overcome the full or partial loss of their right to use their own business name, product names, logos, slogans and/or Domain Names. The greatest expense of a trademark is the lack of it.

WHY DO YOU NEED TO CONDUCT A SEARCH ?

  • Make sure that no one is legally using your name right now in the marketplace.
  • Make sure that you are not infringing upon your competitor’s rights.
  • Determine if your business name has the ability to expand into a new country.
  • Determine whether or not to proceed with your proposed name.
  • Save MILLIONS OF DOLLARS in your production or services line

Please do not underestimate the value of a trademark search. Trademark search is optional, but it is very fundamental to know the full extent of any possible use of your mark prior to filing your trademark application. Conducting a search does not require you to register for a trademark but it will enable you to analyze any conflicting marks that may already exist in the marketplace.

What is a Trademark?

A trademark or trade mark, identified by the symbols ™ and ®, or mark is a distinctive sign or indicator used by an individual, business organization or other legal entity to identify that the products and/or services to consumers with which the trademark appears originate from a unique source of origin, and to distinguish its products or services from those of other entities.

A trademark is a type of intellectual property, and typically a name, word, phrase, logo, symbol, design, image, or a combination of these elements. There is also a range of non-conventional trademarks comprising marks which do not fall into these standard categories.

What is the differences between copyright, patent, and trademark?

Trade mark is different from copyright and patent. A copyright provides protection for an artistic or literary work. A patent provides protection for an invention. Unlike copyrights and patents, trade marks rights can last indefinitely, if the trade mark continues to be used.

Only the owner of the trademark can register the trade mark. The owner can be an individual, partnership or a company.
Why Trademark Search?
In many countries, trademark office register mark without comparing them with the existing registered trademark earlier. You run the risk of infringing someone's mark if you do not conduct a trademark search prior to using a trademark in the particular marketplace. It would cost you to change your mark if there is an opposition from registered owner of the similar mark in the particular marketplace.
